💡 What is Legal protection insurance?Getting a letter from the tax authority (SPF Finances / FOD Financiën) is stressful, even when everything is in order. That is exactly what Legal protection insurance is built for. If you get audited, it covers up to €5,000 of the accounting and legal fees involved in defending your case.
It is underwritten by our partner ARAG and managed by the broker All Insure. You keep full freedom to work with your own accountant, and there is nothing extra to pay. |
✅ Who's covered?
The protection is automatically included in the yearly MAX plan, with nothing to activate on your side. To be eligible:
You are self-employed as a natural person (one-person companies are not covered).
You are on the yearly MAX plan.
You have at most 3 employees (≤3).
An employee here means anyone under an employment contract, whatever their working-time regime or contract length (fixed-term or open-ended). The following do not count: students, interim or temp workers, sub-contractors, helpers and flexi-jobs.
📆 Since when are you covered? Your coverage runs from 1 January of the year you subscribe, and renews every 1 January. So if you subscribe in September, you are still covered from 1 January of that same year. |
💶 What does it cover?
Up to €5,000 per case. This pays for the fees and costs of the experts, lawyers and advisors who defend your file, plus related costs such as a bailiff where one is needed.
For experts and technical advisors such as your accountant, reimbursement runs up to €160 per hour excluding VAT.
The €5,000 is a maximum per case, not per year. If an audit leads to a decision you disagree with, then an appeal, then court, that is all one case sharing the same €5,000. The same applies when several assessment years are part of the same dispute.
Which audits does it cover? A tax audit or dispute linked to your professional activity, from the first letter from the tax office through a disagreement, an appeal and, if needed, court proceedings.
🧑💼 You choose your accountant
You are free to choose whoever you want to represent you. If you do not have an accountant yet, that is fine too, and we can point you to one of our partner accountants if it helps. There is no requirement to have worked with someone before.
What matters is the order:
When you receive a letter from the tax office, contact us first.
We put you in touch with All Insure, the broker.
All Insure approves the expert of your choice, and from that point the protection covers up to €5,000 of the fees. For experts and technical advisors such as your accountant, this is reimbursed up to €160 per hour excluding VAT within that ceiling, so if the hourly rate is higher, the difference stays with you.
The only exception is genuine urgency: if something really cannot wait, you can act first and settle the details with All Insure afterwards.
📄 Your certificate
Your co-branded certificate (Accountable + ARAG) is the proof of your cover.
You will find it in the app, under Settings > My Max Plan.
It first shows as "pending validation", then "validated" once All Insure confirms it (at the latest on the next business day after you subscribe).
Once validated, you also receive a confirmation email with a link to the certificate and claim instructions.
👉 What to do if you're audited?
Email tax-coach@accountable.eu with the letter from the tax office and your certificate.
We forward it to All Insure, who then contact you directly and handle the case from there.
Two things make a claim go smoothly: report it promptly (a late claim can be refused), and do not commit to any costs before All Insure has agreed to them.
🚫 What isn't covered?
The main exclusions:
An audit or dispute already announced or underway before your coverage started
Anything arising from a tax return filed late or not filed
Fraud (if fraudulent intent is established, ARAG can reclaim everything it paid)
Cases following directly from a criminal investigation against you
Advance ruling requests and regularization declarations
A request for information about someone else
A tax dispute unrelated to your professional activity
A repeat dispute on a matter a court has already settled
Director's liability under art. 442quater WIB 1992 or art. 93undecies WBTW
Disputes between you and ARAG, or between you and Accountable
ℹ️ What if my situation changes?
You cancel MAX or downgrade: your coverage runs until 31 December of the year your MAX subscription ended. After that, you keep protection for an audit that arrives later, as long as you were covered during at least one of the assessment years it concerns.
You stop your activity (voluntarily): coverage runs until the end of the year following the one in which you stopped, and you keep protection afterwards for an audit relating to a year you were covered for.
You take on more than 3 employees: coverage runs until 31 December of the year your headcount went above 3, with the same after-the-fact protection for covered years.
You convert to a company: coverage is for natural persons only, so it ends at 31 December of that year.

What if I'm on the monthly MAX plan?
Legal expenses insurance is only available with an annual Max subscription. If you have a monthly subscription without an annual commitment, you are not covered. However, if you pay monthly under a 12-month contract, you are covered.
